Oak Brook Resident Co-Authors Article in Illinois Bar Journal

Jessica Livieres and Andrew Cho (a resident of Oak Brook), law students at the University of Illinois College of Law and the John Marshall Law School, respectively, and Hon. E. Kenneth Wright, Jr., presiding judge of the First Municipal District, are the authors of “Offers of Judgment: Federal Rule 68 in Illinois?,” an article which appears in the May 2014 issue of the Illinois Bar Journal, the monthly magazine of the Illinois State Bar Association (ISBA). 

In the article, the authors explore the background and purpose of Federal Rule 68 and how to address its many shortcomings if Illinois should adopt a similar offer-of-judgment provision. Rule 68 allows a defendant to serve an offer of judgment on the plaintiff and makes the plaintiff who rejects the offer liable for post-offer costs if she fails to improve on the offer at trial.
