Wahl, D86 Board Banned From Bad-Mouthing Each Other

A clause in the resignation agreement reached between Wahl and the board mandates that neither party "will directly or indirectly disparage" the other.

Anyone hoping to hear former District 86 Superintendent Nicholas Wahl blast the board of education or board members call out Wahl shouldn't hold their breath.

A clause in the resignation agreement reached between Wahl and the board prohibits parting shots between the two parties, which could explain why the ex-superintendent has not responded to Patch’s request for comment since moving on to a new job in Indiana and why no negative opinions of him or his sudden departure have been made public by any board members.

“The board and Wahl agree that neither Wahl nor the board (including its members, officers, agents, and administrators), will directly or indirectly disparage, defame, make derogatory or negative statements to any person or entity about the other,” reads the agreement that was signed by Wahl on Aug. 2 and Board President Claudia Manley on Aug. 5.

The resignation agreement, which was provided by District 86 in response to a FOIA request, required Wahl to prepare a memorandum assisting acting Superintendent Bruce Law begin the 2013-14 school year and mandates that he cooperate “if requested to do so” in finding his permanent replacement.

“Wahl further agrees that he will not, for a period of one year from August 5, 2013, directly or indirectly recruit or solicit for employment any current District 86 employee, or otherwise encourage any current District 86 employee to resign employment in District 86,” the agreement reads.

As noted by Manley when Wahl’s resignation was first announced Monday, a clause in the agreement waives the 120-day notification period that Wahl would have otherwise been required to serve according to his contract.

The former superintendent will receive "his full salary and benefits through and including August 5, 2013," the agreement reads. His unused sick days will be reported by the board to the Illinois Teachers' Retirement System, and Wahl will be paid for any presently accrued but unused vacation days.
