Commercial Tax-Appeal Intervention on Monday's D86 Agenda

The board plans to discuss the rescinding of an earlier resolution that made intervention automatic for appeals exceeding $100,000.

The School Board will get together Monday night for a Committee of the Whole meeting at in Darien and will discuss, among other items, whether or not to rescind a resolution it approved over the summer authorizing the district's legal team to intervene in all commercial property tax appeals that seek reductions of $100,000 or more.

The resolution to be discussed Monday would allow the district's lawyers to continue working on any pending commercial cases. Going forward, the board would authorize intervention in commercial appeals exceeding $100,000 on a case-by-case basis.

“Whether that store in Hinsdale is worth $2.7 million or $2.1 million, nobody here knows that and our lawyers sure don’t know that,” board member Dr. Richard Skoda said on Sept. 26. “On the other hand, if Oakbrook Center was in our district and they’re assessed at $1 billion and want to go down to half a billion, well obviously that’s something we’d have to look at.”

Skoda originally wanted the item being to be added as an amendment to a resolution approved Sept. 26 that halted intervention in all residential property tax appeals. He withdrew his request for that amendment with the understanding that the item would be considered and discussed at a future meeting.

On Sept. 26, the board voted 6-1 to end the district's intervention in residential appeals. (.)
