Man Pleads Guilty to Punching Nurse, Gets Two Years Probation

Prosecutor brought the battery charge down from a felony to a misdemeanor because the offender has sought treatment.

Timothy Kim, of 230 Sype Dr. in Carol Stream, pleaded guilty to Class-A misdemeanor battery Monday morning at the DuPage County Judicial Center nearly 10 months after punching in the stomach an Adventist Hinsdale Hospital nurse who was treating him.

Judge Blanche Hill Fawell sentenced Kim to two years' probation.

According to prosecutor John Botti, the battery charge against Kim—originally a felony aggravated battery charge because nurses are a protected class—was reduced to a misdemeanor partly because Kim has attended "significant outpatient treatment" since the offense.

, he was on probation for a 2009 possession of a controlled substance offense. 

Deputy Hinsdale Police Chief Mark Wodka said when the incident was reported that Kim was "highly intoxicated" and was "acting belligerently" towards hospital staff that night.

"At that time, there was no criminal activity that had occurred," Wodka said. "We were called back again when the suspect became unexpectedly agitated with the nurse treating him, punching her in the stomach with his fist."

Botti said in addition to the probation, the 24-year-old Kim will submit to monthly urine tests, will not consume alcohol for the next 30 days, and will be monitored via a Secure Continuous Remote Alcohol Monitor (SCRAM) ankle bracelet for the next 30 days. 

"Like Lindsay Lohan," Botti said.
