Case of Man Charged With Assaulting Nurse Continued to September

Prosecutor says he expects either a plea agreement to be reached or a trial date to be set when the case resumes.

A Carol Stream man charged with aggravated battery after allegedly punching a nurse last winter will have to wait at least a month before he learns his fate.

Timothy S. Kim, 24, is accused of punching in the stomach a female nurse who had been treating him in the emergency room at Adventist Hinsdale Hospital the morning of Dec. 12.

The case, which came before Judge Blanche Hill Fawell Monday morning, was continued to Sept. 12.

“It was continued for a possible plea,” prosecutor John Botti said after the hearing. “We’re going to continue our negotiation, and hopefully on the 12th it will be resolved.”

Normally the incident would be considered a misdemeanor, but because nurses are a protected class, it is a felony charge, Hinsdale Police previously said.

Botti said he anticipates some type of action in September, whether it is a plea agreement or setting a trial date. 

Kim’s attorney could not immediately be reached for comment Monday.

At the time of the alleged incident, Kim was serving probation after pleading guilty to possession of a controlled substance in August 2009. He was sentenced to two years probation, and was fined at least $1,200 for the offense.

In August 2010, Kim was arrested by Naperville police in a parking garage after allegedly making two fake calls to 911, court records indicate. He was charged with disorderly conduct, as well as criminal damage to property after allegedly spitting on the walls of a holding cell at the Naperville Police Department.
